NY Ins. Ch. 28

New York State substantive insurance law is codified under Chapter 28 of the Consolidated Laws, known as the "Insurance Law."

NY Fin. Serv. Ch. 18-A

Article 2 of the Financial Services Law provides for the establishment of the Insurance Division of the New York Department of Financial Services (DFS). Article 3 sets forth particular powers of the superintendent of the DFS.

Regulations

Title 11 of the NYCRR

§302 of the New York Financial Services Law vests power in the superintendent of the New York Department of Financial Services to supervise and regulate insurance activities throughout the State. Insurance regulations can be found in Title 11 of the New York Codes, Rules and Regulations (NYCRR).

Department of State, Division of Administrative Rules

  • Provides an unofficial version of the New York Codes, Rules, and Regulations (NYCRR)
  • Click on the link at the top of the page "VIEW THE UNOFFICIAL NYCRR ONLINE HERE"
  • On the new page that opens, scroll to and click on "Title 11. Insurance Department" to view the Insurance Department regulations
  • Click on the small plus sign to expand the table of contents and view a particular regulation
  • In order to be sure that you are viewing the most current regulations, also view the weekly New York State Register, available here, for recent rule adoptions that have not yet been incorporated into the unofficial online NYCRR

Department of Financial Services

  • Includes text of proposed regulations, emergency regulations, final current regulations, withdrawn regulations and additional supplementary materials
  • Click "Insurance" under either "Proposed Regulations", "Regulations Adopted on an Emergency Basis" or "Final Adoptions," as applicable.
  • See "Insurance" heading for additional content, including regulations organized by chapter, withdrawn regulations, and other regulatory actions (including notices of adoption and public notice forms)
